Privacy Policy

The short version: Nearlii helps you discover local deals and helps businesses reach nearby customers. To do that, we collect account, location, device, usage, and transaction information. We never sell your personal information. You can request access to, correction of, or deletion of your data at any time by contacting us at info@nearlii.com.

1. Scope of This Policy

This Privacy Policy explains how Nearlii Technologie Inc. (“Nearlii,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you use the Nearlii mobile application or nearlii.com website (together, the “Service”).

Nearlii operates a local deals platform and is currently available to users in Canada, the United States, Malaysia, Bangladesh, and Sri Lanka. Where the privacy laws of your country grant you additional or different rights, those rights are described in Section 9, “Your Rights by Region.”

This Privacy Policy should be read together with our Terms of Service. By using the Service, you agree to the collection and use of information as described here.

2. Information We Collect

We collect the following categories of information:

  • Account Information: Name, email address, phone number, and password when you register or sign in (including via third-party sign-in providers).
  • Precise Location Data: With your permission, we collect your device's GPS location, either while the app is in use or, if you separately enable it, in the background, so we can show you deals near you. You can withdraw this permission at any time in your device settings, though some features may stop working.
  • Usage & Analytics Data: We use analytics tools (such as Firebase/Google Analytics) to collect information about how you interact with the Service, including screens viewed, deals clicked, session length, and crash/diagnostic data.
  • Device Information: Device type, operating system and version, unique device and advertising identifiers, IP address, and general (non-precise) location derived from your IP address.
  • Push Notification Data: A device token used to send you deal alerts and account notifications. You can disable push notifications at any time in your device settings.
  • Transaction Information: Details about deals you redeem or purchase, including transaction amount and timestamp. Payment card data is collected and processed directly by our third-party payment processor(s) — Nearlii does not store full payment card numbers on its own servers.
  • Business Information: For business partners, we collect business name, address, contact details, tax/registration information where required for payouts, and deal content.
  • Communications: Information you provide when you contact customer support, respond to surveys, or otherwise communicate with us.

3. How We Use Your Information

We use the information we collect to:

  • Create and manage your account and authenticate you.
  • Show you relevant deals based on your location and preferences.
  • Process transactions and deal redemptions, including through our payment processor(s).
  • Send deal alerts, transactional messages, and — with your consent where required — promotional communications.
  • Operate, maintain, troubleshoot, and improve the Service, including through analytics and crash reporting.
  • Respond to your inquiries and provide customer support.
  • Detect, investigate, and prevent fraud, abuse, and security incidents.
  • Comply with applicable legal, tax, and regulatory obligations in the countries where we operate.

4. How We Share Your Information

We do not sell your personal information. We share information only in the following circumstances:

  • Business Partners: Limited information (such as your name and redemption details) necessary to facilitate and verify deal redemption.
  • Service Providers: Vendors who process data on our behalf, including cloud hosting, analytics, push notification delivery, payment processing, and customer support tooling. These providers are contractually required to protect your information and use it only to provide services to us.
  • Payment Processors: Third-party payment processors that handle payment card data directly, subject to their own privacy and security standards (such as PCI DSS).
  • Legal & Safety: When required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Nearlii, our users, or the public.
  • Business Transfers: In connection with a merger, acquisition, financing, or sale of assets, in which case we will notify you of any change in ownership or use of your personal information.

5. Cookies & Tracking Technologies

We use cookies, mobile SDKs, and similar tracking technologies to keep you signed in, remember your preferences, measure performance, and understand how the Service is used. You can control cookies through your browser settings, and control mobile identifiers and tracking permissions through your device settings (for example, iOS App Tracking Transparency or Android ad settings). Disabling certain cookies or identifiers may affect the functionality of the Service.

6. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Service, comply with our legal obligations (including tax and accounting requirements in the countries where we operate), resolve disputes, and enforce our agreements. When you request deletion of your account, we delete or anonymize your personal information within a reasonable period, except where retention is required by law.

7. Data Security

We use administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction, including encryption in transit and access controls on our systems. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8. International Data Transfers

Because Nearlii operates across Canada, the United States, Malaysia, Bangladesh, and Sri Lanka, your information may be transferred to, stored, and processed in a country other than the one in which you reside, including countries that may have data protection laws different from those in your country. Where we transfer personal information internationally, we take reasonable steps to ensure it receives an adequate level of protection, including through contractual safeguards with our service providers.

9. Your Rights by Region

Depending on where you live, you may have specific rights over your personal information. To exercise any of the rights below, contact us at info@nearlii.com. We may need to verify your identity before fulfilling your request.

Canada

We handle personal information in accordance with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. You have the right to access the personal information we hold about you, request correction of inaccurate information, and withdraw consent to certain uses, subject to legal and contractual restrictions. If you are a resident of Quebec, you may also have additional rights under Quebec's Act respecting the protection of personal information in the private sector, including the right to data portability. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.

United States

Residents of certain U.S. states (such as California, Colorado, Connecticut, Virginia, and others with comprehensive privacy laws) may have the right to know what personal information we collect, request access to or deletion of that information, correct inaccuracies, and opt out of the “sale” or “sharing” of personal information for targeted advertising. Nearlii does not sell your personal information for money. To the extent our use of analytics or advertising technologies is considered “sharing” under applicable state law, you can opt out by contacting us at info@nearlii.com or by adjusting your device's ad tracking settings. We will not discriminate against you for exercising these rights.

Malaysia

We process personal data in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA). You have the right to access your personal data, request correction of inaccurate data, and, subject to certain exceptions, withdraw your consent to our processing of your personal data by contacting us. You may also lodge a complaint with the Personal Data Protection Department of Malaysia (Jabatan Perlindungan Data Peribadi).

Bangladesh

We handle personal data in accordance with applicable laws and regulations of Bangladesh governing data privacy and protection, including the Information and Communication Technology Act, 2006, applicable Bangladesh Telecommunication Regulatory Commission (BTRC) directives, and any subsequent personal data protection legislation that comes into force. You may contact us to request access to, correction of, or deletion of your personal data, and we will respond in accordance with applicable law.

Sri Lanka

We process personal data in accordance with Sri Lanka's Personal Data Protection Act, No. 9 of 2022. You have the right to request access to, correction of, and erasure of your personal data, to object to certain processing, and to lodge a complaint with the Data Protection Authority of Sri Lanka.

10. Children's Privacy

The Service is intended for users who are at least 18 years old, consistent with the account eligibility requirement in our Terms of Service. We do not knowingly collect personal information from anyone under 18, including children under 13 as defined by the U.S. Children's Online Privacy Protection Act (COPPA). If you believe we have inadvertently collected information from a minor, please contact us at info@nearlii.com and we will promptly delete it.

12. Marketing & Opt-Outs

You can opt out of promotional emails at any time by using the unsubscribe link in those emails, and opt out of promotional push notifications in your device settings. You will still receive transactional or account-related messages (such as deal redemption confirmations) necessary to operate the Service. Our website does not currently respond to browser “Do Not Track” signals.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the countries we operate in, or applicable law. We will post the updated policy on this page with a revised effective date, and where changes are material, we will provide additional notice (such as an in-app notification or email). Your continued use of the Service after an update constitutes your acceptance of the revised policy.
